I'd argue that there are certainly some First Amendment issues with the 
DMCA, as well as some issues regarding patents and copyright (the 
Constitution specifies that exclusive rights will be granted to inventors 
for a limited time, the current schema effectively has no limit to those 
rights, which goes against the stated intention of the Constitutional 
power, which is to promote the progress of science and useful arts).  This 
relates to linux in the context that efforts to subvert standards in order 
to establish de facto monopolies can block attempts to reverse-engineer the 
basic mechanisms of how software works, endangering projects such as WINE 
and Loki's linux game porting efforts.
