You forgot to mention that the Patent and Trademark office cancelled the
patent after someone pointed out prior widely-known art.

Similarly, one cannot enjoy a valid trademark on a widely used name.

E.g., years ago DEC trademarked "Dumb Terminal" long after that name was
in common usage.  (Unlike patents, to claim a trademark one merely puts
a superscript "TM" after it.)  They'd never would have won a suit.
